printpal - API Terms of Use

We sincerely welcome you and thank you for your interest in PrintPal ("Company", "we," "us," or "our") and our API services. These API Terms of Use are a legally binding contract between you and PrintPal regarding your use of our API Services.

PLEASE READ THESE API TERMS OF USE CAREFULLY

By generating an API key, making API requests, or otherwise accessing our API Services, you represent that you have read, understand, and agree to be bound by these Terms.

1. DEFINITIONS

API User: A developer or entity that accesses the Services via the Application Programming Interface (API) provided by PrintPal.

API Key: A unique authentication credential issued to you for accessing our API Services.

API Credits: Digital units used exclusively within the platform to access API features and generate 3D models.

Services: PrintPal's 3D model generation API that converts images into 3D models using AI technology.

2. API KEY AND AUTHENTICATION

2.1 API Key Issuance

Upon registration and agreement to these Terms, you will be issued API keys to authenticate your requests. You are responsible for:

Keeping your API keys confidential and secure
All activity that occurs under your API keys
Immediately notifying us if you suspect unauthorized use

2.2 API Key Security

You must not:

Share your API keys with unauthorized parties
Embed API keys in publicly accessible code repositories
Use API keys in client-side applications without proper security measures
Attempt to circumvent API authentication mechanisms

3. API CREDITS AND PAYMENT

3.1 Credit System

Access to our API Services requires API Credits. Credits are consumed based on the type and complexity of 3D generation requests:

Standard 3D generation: 1 credit per request
High-quality 3D generation: 2 credits per request
Ultra-quality 3D generation: 4 credits per request
Super Resolution (1024³): 8 credits per request

3.2 Credit Purchase

Credits can be purchased through our website using valid payment methods accepted by our payment processor. By purchasing credits, you authorize us to charge your payment method for the specified amount.

3.3 NO REFUND POLICY

IMPORTANT: ALL API CREDIT PURCHASES ARE FINAL AND NON-REFUNDABLE

Due to the significant computational costs inherent in providing AI-powered 3D generation services, we do not offer refunds for purchased API credits under any circumstances, including but not limited to:

Unused credits
Dissatisfaction with generated results
Changes in business needs
Account termination (voluntary or involuntary)
Service interruptions or errors

By purchasing API credits, you explicitly acknowledge and agree to this no-refund policy.

3.4 Credit Expiration

API credits do not expire and remain valid in your account unless your account is terminated for violation of these Terms.

3.5 Credit Deduction

Credits are deducted only upon successful completion of 3D generation requests. Failed requests do not consume credits.

4. API USAGE AND RESTRICTIONS

4.1 Permitted Use

You may use our API to generate 3D models from images for legitimate business purposes, including:

Integration into your own applications or services
Providing 3D generation capabilities to your end-users
Internal business operations and development

4.2 Prohibited Use

You shall not:

Use the API to develop competing 3D generation services
Train, benchmark, or improve competing AI models using our API
Reverse engineer, decompile, or attempt to extract our AI models
Submit illegal, harmful, or infringing content
Generate content that violates intellectual property rights
Engage in abusive or excessive usage patterns
Resell or redistribute API access without authorization
Submit content containing personal data of minors
Use the API for any unlawful purpose

4.3 Rate Limits

We implement reasonable rate limits to ensure fair usage. Excessive requests may be throttled or blocked. Current limits:

Maximum 100 requests per minute per API key
Maximum 10,000 requests per day per account

Enterprise users may request higher limits by contacting support.

5. CONTENT AND INTELLECTUAL PROPERTY

5.1 Your Input Content

You retain ownership of all images and data you submit to the API ("Input"). You represent and warrant that:

You own or have necessary rights to the Input
The Input does not infringe on any third-party rights
The Input complies with all applicable laws
You have obtained all necessary consents to submit the Input for processing

5.1A Third-Party Processing Acknowledgment

IMPORTANT NOTICE: By using our API Services, you explicitly acknowledge and agree that:

Your Input content may be transmitted to and processed by third-party AI service providers
Depending on the specific API endpoint, quality level, and our current infrastructure, we may use our own AI models or external services
When external services are used, these providers perform the actual 3D generation, image processing, and other AI operations
These providers operate under their own privacy policies and data protection practices
Your content may be temporarily stored by these providers during processing
These providers may use de-identified data to improve their AI models
We select providers based on security standards but do not control their data practices

If you submit content on behalf of end-users, you are solely responsible for:

Obtaining necessary consents from your end-users for potential third-party processing
Providing appropriate privacy notices about the possibility of third-party AI processing
Ensuring compliance with applicable data protection laws (GDPR, CCPA, etc.)

5.2 Generated 3D Models (Output)

Subject to your compliance with these Terms and payment of applicable credits, you own the 3D models generated by our API ("Output"). However:

Outputs are generated by AI and may not be unique
We make no warranties regarding copyrightability of Outputs
You are solely responsible for ensuring your use of Outputs is lawful

5.3 License to PrintPal

You grant us a limited license to use your Input solely to:

Provide the API Services to you
Improve our AI models and services (in de-identified form)

We will not publicly disclose or commercially exploit your Input or Output without your authorization.

6. DATA PRIVACY AND SECURITY

6.1 Privacy Policy

Our collection and use of data is governed by our API Privacy Policy, which is incorporated into these Terms by reference.

6.2 Your Responsibilities for End-User Data

If you process data of your end-users through our API, you are solely responsible for:

Obtaining necessary consents from your end-users
Complying with applicable data protection laws (GDPR, CCPA, etc.)
Providing appropriate privacy notices to your end-users
Responding to data subject rights requests from your end-users

7. SERVICE AVAILABILITY AND SUPPORT

7.1 Service Level

We strive to maintain high availability but do not guarantee uninterrupted access. The API is provided "as is" without warranties of uptime or performance.

7.2 Maintenance and Updates

We may perform scheduled maintenance or emergency updates that may temporarily affect API availability. We will provide advance notice when possible.

7.3 Support

API support is provided via email. Response times vary based on issue severity and your account type.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR API CREDITS IN THE 12 MONTHS PRECEDING THE CLAIM
WE ARE NOT LIABLE FOR ANY LOSSES RESULTING FROM YOUR USE OF GENERATED 3D MODELS
WE ARE NOT RESPONSIBLE FOR CONTENT YOU SUBMIT OR GENERATE

9. INDEMNIFICATION

You agree to indemnify and hold PrintPal harmless from any claims, damages, or expenses arising from:

Your use of the API Services
Your violation of these Terms
Your Input or Output content
Your end-users' actions
Your violation of any third-party rights

10. TERMINATION

10.1 Termination by You

You may terminate your API access at any time by deleting your API keys and closing your account. Unused credits are forfeited upon termination.

10.2 Termination by PrintPal

We may suspend or terminate your API access immediately if you:

Violate these Terms
Engage in fraudulent or abusive behavior
Fail to pay for purchased credits
Pose a security risk to our systems

Upon termination, unused credits are forfeited without refund.

11. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the API after changes constitutes acceptance. Material changes will be announced via email or platform notification.

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for claims that qualify for small claims court.

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PrintPal regarding the API Services.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

13.3 No Waiver

Our failure to enforce any right does not constitute a waiver of that right.

13.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms at any time.

ACKNOWLEDGMENT

BY GENERATING AN API KEY OR USING THE API SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM, INCLUDING THE NO-REFUND POLICY FOR API CREDITS.
